These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and MusiciansDomain.com governing your access to and use of the Platform, including but not limited to music and video uploads, hosting services, artist profiles, marketing tools, and all related promotional features.
By creating an account, uploading or submitting content, or otherwise using any portion of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform.
MusiciansDomain.com operates as a promotional platform intended to assist musicians in showcasing their music, videos, branding elements, and other creative works.
The Platform:
does not generate royalties,
does not distribute content to third-party music services, and
does not function as a streaming, publishing, or music-licensing provider.
Users wishing to earn royalties or distribute their music to services such as Spotify, Apple Music, or YouTube must do so exclusively through the official external distribution upload link provided by MusiciansDomain.com.
All content uploaded directly to the Platform is for promotional purposes only.
By accessing or using the Platform, you represent and warrant that:
You are at least 18 years of age.
You are legally capable of entering into binding contracts.
You accept and agree to comply with the Platform’s Privacy Policy, Copyright Policy, and all related guidelines.
By uploading or submitting any music, audio, video, artwork, images, metadata, or other materials (“Artist Content”), you affirm and warrant that:
You are the sole and exclusive owner of the Artist Content; or
You have obtained all necessary rights, permissions, licenses, and authorizations to upload, publish, share, and promote the Artist Content on the Platform.
You further confirm that your Artist Content:
does not infringe any copyright, trademark, privacy, publicity, or intellectual property rights;
is fully cleared for public display, streaming, and promotional use;
does not require MusiciansDomain.com to obtain any additional licenses or pay royalties; and
remains your exclusive property, with ownership fully retained by you.
By uploading or submitting Artist Content, you grant MusiciansDomain.com a worldwide, non-exclusive, royalty-free, transferable license to:
host and store the Artist Content;
display, publish, and publicly stream the Artist Content;
promote the Artist Content on the Platform; and
use the Artist Content in marketing materials, demonstrations, artist features, and promotional campaigns.
This license exists solely to enable Platform operation, public display, and promotion.
You may revoke this license by removing your content or deleting your account, except with respect to content already used in previously published promotional materials.
If you provide content to MusiciansDomain.com via email, message, external link, or any other method for the purpose of having it uploaded on your behalf, you expressly acknowledge and agree that:
You authorize MusiciansDomain.com to upload the content;
You own or control all rights necessary to authorize such upload;
You grant the same rights and licenses as though you uploaded the content directly; and
MusiciansDomain.com bears no responsibility for any copyright, licensing, or ownership disputes or claims relating to content you provided.
All content uploaded directly to the Platform is used exclusively for promotional display.
MusiciansDomain.com:
does not pay royalties,
does not monetize your music,
does not collect streaming or performance fees, and
does not distribute content to third-party music services.
Artists seeking royalties must upload through the designated distribution link.
You agree that:
You are solely responsible for all Artist Content you upload or submit.
You have legally obtained all required rights and clearances.
You will not upload any copyrighted material without proper authorization.
You will comply with all applicable laws in your jurisdiction.
You assume full responsibility for any legal, financial, or reputational consequences arising from your content.
You agree to indemnify, defend, and hold harmless MusiciansDomain.com, its owners, partners, affiliates, and employees from any and all claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:
your Artist Content;
copyright or intellectual property infringement;
misrepresentation of ownership rights;
your breach of these Terms; or
any third-party claims resulting from your content.
This obligation survives termination of your account or use of the Platform.
By uploading Artist Content, you authorize MusiciansDomain.com to:
host and publicly display your content;
stream your content on the Platform;
promote your content and profile through marketing, advertising, and social media channels.
MusiciansDomain.com does not compensate Users for views, streams, or engagement unless expressly stated under a future monetization program.
You are strictly prohibited from:
uploading illegal, harmful, defamatory, or offensive content;
uploading content you do not own or have rights to;
attempting to hack, disrupt, or interfere with Platform operations;
uploading malware, viruses, or harmful code;
impersonating any person, artist, or entity;
engaging in any unlawful or fraudulent activity.
Violations may result in immediate suspension or permanent termination of your account.
MusiciansDomain.com reserves the right to update or modify these Terms at any time.
Revised Terms become effective upon posting.
Continued use of the Platform constitutes your acceptance of the updated Terms.
We may suspend or terminate your account at our discretion for reasons including, but not limited to:
violations of these Terms,
repeated copyright claims,
fraudulent or malicious activity,
uploading illegal or harmful material, or
misuse of Platform features.
Upon termination, your content may be removed without prior notice.
The Platform is provided on an “as-is” and “as-available” basis, without warranties of any kind.
MusiciansDomain.com does not guarantee:
uninterrupted or error-free service,
any specific level of promotion,
distribution outcomes, or
future monetization.
You use the Platform entirely at your own risk.
To the maximum extent permitted by law, MusiciansDomain.com shall not be liable for:
financial loss or lost profits;
data loss or corruption;
claims arising from your content;
interactions with third parties;
service interruptions; or
unauthorized access to your account.
These Terms are governed by and construed in accordance with the laws of South Africa.
All disputes shall be resolved exclusively in the courts of South Africa.
By uploading, submitting, or authorizing the upload of any content, you expressly confirm the following:
“By proceeding, I affirm that I own or control all rights to this content, and I accept full responsibility for any claims or liabilities arising from its upload. I agree to be bound by the MusiciansDomain.com Terms of Service.”
